After another collapse of the Russian ruble in 2014-2015. mortgage borrowers who took a loan in foreign currency faced the need to pay huge amounts to the bank. And not at all those on which they counted, concluding a loan agreement. Once in financial bondage, they turned to the state for help.

At first, officials of all stripes convinced disgruntled citizens that the sharply increased debt was a consequence of their greed and hindsight. But then the statesmen nevertheless developed a program to help mortgage borrowers. True, not for all debtors affected by a significant fall in the national currency.

The assistance program has been running since 2015. However, there were so many people who wanted to solve their financial problems at the expense of the state that the budget funds allocated for the project ran out, and the project itself was curtailed.

But at the end of the summer of 2017, the state decided to extend the program. On August 11, 2017, government decree No. 961 was issued on further measures to support mortgage lenders in a difficult financial situation. Some changes have been made to the existing program. From its content, it became clear that the state was completely oriented towards supporting the unlucky foreign exchange debtors.

The new program has a number of features:

  1. Assistance to citizens with unsustainable mortgage debt is provided through its restructuring. This means that the loan is not “forgiven”, but the bank renews a new loan agreement with the client, with more favorable conditions for the borrower. Or draws up an additional agreement to the old one. The main purpose of the drawn up documents is to reduce the financial burden on the debtor, to make the loan agreement enforceable.
  2. No more than 30% of the mortgage debt is compensated at the state expense. At the same time, the maximum possible amount that can be allocated for partial repayment of the loan is 1.5 million rubles.
  3. The state warns that the assistance is provided one-time, and in further risky transactions with the bank, citizens will have to rely solely on themselves.

When paying off part of the debt through the assistance program, the bank is obliged to restructure the loan on certain conditions:

  1. Re-register foreign currency loans in rubles - at the rate in force at the time of the conclusion of the renewed agreement;
  2. Set the interest rate for the borrower no more than 11.5% (annual);
  3. “Forgive” the client a certain amount of debt - at least 1.5 million rubles (due to partial write-off and / or recalculation at a more favorable exchange rate);
  4. Do not charge the debtor for late payments a penalty (with the exception of amounts collected by a court decision and fines paid earlier);
  5. Do not shorten the terms of fulfillment of credit obligations by the debtor.

On behalf of the state, assistance to mortgage borrowers is provided by AHML. This is the short name of the “Agency for Housing Mortgage Lending”, through which banks receive funds in the amounts of lost income from the client. That is, by urging creditors to meet the debtors, the state from the treasury covers their costs arising from the mitigation of the terms of the mortgage agreement (within the established limits). 2 billion rubles were transferred to the Agency's account for these purposes.

Pay attention: the maximum possible amount of compensation may be increased, but not more than twice its amount. The decision on this is made by a special interdepartmental commission - at the request of the debtor.

Currently, the AHML official website contains information that mortgage debt restructuring is possible in 2 types:

  1. Reducing the interest rate;
  2. Recalculation in ruble equivalent at a lower rate.

Who can count on support

The government dictates tough conditions for those who are going to participate in it. The August government decree significantly reduced the list of citizens to whom the state is ready to cover part of the debt. For example, earlier it included employees of defense enterprises, municipal employees, and scientists. They are not on the new list.

In 2019, the assistance program applies only to the following categories of borrowers:

  1. Adult citizens with disabilities;
  2. Parents raising children with disabilities;
  3. Veterans who participated in armed conflicts of recent decades (combat operations);
  4. Parents / guardians / guardians of minor children (in any number);
  5. Parents who provide financial support for their children, who study full-time in various educational institutions - until the “children” reach the age of 24.

This list is closed, that is, exhaustive. However, strict requirements are imposed not only on debtors, but also on real estate, which is purchased with money borrowed from the bank.

Real estate requirements

The assistance program applies to certain residential properties.

They have to:

  1. be located in Russia;
  2. Be the only housing of the borrower and his household (it is allowed for them to have a share in another apartment/house/room, but not more than 50%);
  3. Do not exceed the established dimensions of the total area of ​​the room:
  • 85 m2 - for a 3-room (or more) residential facility;
  • 65 m2 - for a 2-room residential facility;
  • 45 m2 - if a property with 1 living room is taken in a mortgage.

It is interesting that in the previous program, great attention was paid to the cost per square meter of housing purchased with a mortgage. It should not exceed the average market for the region by more than 60%. And the maximum footage was set not by the number of rooms, but by the number of members of the mortgagor's family living in a mortgage apartment. However, the updated assistance program from AHML does not contain these restrictions.

Requirements for borrowers

In order to participate in the program, borrowers must not only be included in the above list of “preferential” categories, but also meet very important additional criteria:

  1. 3 months before applying to the bank for mortgage restructuring, the average income of each member of the borrower's family, after paying the planned amount on the loan, did not exceed two subsistence levels established in their region of residence. Thus, the emphasis is on families with low and medium incomes, in which, despite the regularity of income, a mortgage loan has become an unbearable burden.
  2. At the time of application for restructuring, regular loan payments must increase by at least 30% - compared to the amounts that were planned to be paid to the bank on the day the loan agreement was concluded. This condition cut off ruble-denominated mortgage lenders from the program, who may also be experiencing difficult financial problems. However, such a giant jump in monthly installments is likely only if the mortgage was taken in foreign currency.

Required documents

It will include:

  1. Photocopies of papers proving both the identity of the borrower himself and all his household members: Russian passports, "children's" certificates;
  2. Documents that confirm that he belongs to one of the categories of Russians who have the right to repay a mortgage with the help of the state:
    • certificates for children (if it is their presence that gives the right to state support);
    • veteran's certificate of the established form;
    • certificate of MSEC on the presence of disability - for himself or for his child;
    • paper from an educational institution confirming the fact that a son or daughter is studying full-time, etc.;
  3. Documents evidencing the amount of income of the borrower or solidary debtors, as well as the total income of members of his family - for the last 3 months:
    • photocopies of the pages of the work book;
    • certificates taken at work 2-NDFL;
    • certificate of receipt of unemployment benefits (for able-bodied, but unemployed citizens);
    • an extract from the Pension Fund of the Russian Federation on the amount of the pension for the last year (for pensioners / disabled people or when receiving benefits for a disabled child);
    • an extract on the amount of "custodial" payments, etc.;
  4. A valid mortgage agreement concluded with the creditor bank (it must be executed at least a year before applying for debt restructuring);
  5. Monthly payment schedule - to repay the target loan;
  6. Form No. 9 (provided at the passport office at the place of registration);
  7. An application of the established form, in which the borrower informs about his own property status and his family members, concerns whether they have other real estate (its form can be downloaded and viewed on the AHML official website).

And even such a long list is likely to be incomplete, since different banks participating in the state mortgage subsidy program set their own list of required documentation. Usually it is posted on the electronic portals of credit organizations.

Pay attention: an extract from the USRN on the ownership of the borrower (s) on the subject of collateral, that is, on real estate purchased on credit, banks no longer require applicants. Previously, they had to be taken, but now AHML itself requests this document from Rosreestr.

Assistance Scheme

So, a borrower experiencing difficulties in repaying a loan needs to contact the lender bank and find out if the lender is participating in this state program.

If the answer is positive, the debtor will have to take a number of actions in order to receive assistance from AHML:

  1. You need to find out which department of the bank deals with this issue. Usually this is the department for dealing with debtors (or with overdue debts). By phone or through the website you need to find out his location and contact details.
  2. By calling the department or arriving in person, the borrower specifies what documents he will have to collect for submission to the bank.
  3. Having collected the necessary papers, the citizen sends them to the financial institution along with the application form. It states the reason why the borrower is applying for public assistance.
  4. Having received a package of papers from the debtor, the financial institution sends them to AHML for verification. It is believed that on average it lasts about a month. However, it is better to tune in to a longer wait, as many citizens complain that they had to wait for an answer for six months.
  5. Often, AHML requests additional documents, which the applicant is obliged to provide to him.
  6. If the Agency makes a positive decision, the bank informs the debtor about it and sets a meeting time to draw up a new loan agreement.
  7. At the meeting, either a completely new contract with modified conditions is drawn up, or an additional agreement is drawn up to the current document. An adjusted schedule of regular payments is also developed and signed, a paper is issued on changing the content of the mortgage.
  8. The previous mortgage is requested from the bank's archive. She has to wait 2-4 weeks.
  9. Then all amended, supplemented and newly drawn up documents are submitted for registration. On this, the procedure can be considered completed.

Mortgage has become one of the effective tools for solving the housing problem in Russia. Yes, it has a number of pluses and minuses, which we will consider in a separate post of our project, but this is a real opportunity, especially for young families, to purchase housing.

With the onset of another crisis in the economy, the state had to provide support to mortgage borrowers who found themselves in a difficult financial situation. In April 2015, the corresponding Decree 373 of the Government of the Russian Federation dated April 20, 2015, signed by D.A. Medvedev. JSC "Agency for Housing Mortgage Lending" became the operator of the implementation of this project.

Initially, this resolution provided for the validity of the assistance program until the end of 2016, but it has been repeatedly amended and supplemented. To date, according to the latest changes 373 of the Government Decree dated November 24, 2016, assistance to mortgage borrowers (mortgage restructuring) is valid until March 1, 2017(extended until May 31, 2017 Decree of the Government of the Russian Federation of February 10, 2017 No. 172, since March 7, 2017, the acceptance of new applications has been suspended due to the expenditure of funds under the program.

However, in July 2017, an additional 2 billion rubles were allocated from the government fund to restart the program. On August 11, 2017, new conditions for participation in the mortgage borrower assistance program came out - which you will learn about from this post) and is as follows:

  • The borrower's mortgage obligations to the bank are reduced in the amount of 20% to 30% of the balance (at the discretion of the lender's bank), but not more than 1,500,000 rubles.
  • By agreement between the borrower and the bank, you can choose the format of assistance, namely, either send the entire amount of assistance to the mortgage to pay off the principal and thereby reduce the monthly payment, or to reduce the monthly payment by 50% or more for up to 1.5 years.
  • Replacing a foreign currency mortgage with a ruble one. At the same time, the mortgage rate cannot be higher than 11.5% per annum. For a ruble mortgage, not higher than the bank's current rate, except in cases stipulated by the mortgage agreement, in case of violation of insurance rules.
  • Until September 1, a special interdepartmental commission should be created, which will be able to increase the maximum payment under the program by 2 times and approve applications for participation if there are deviations from the basic conditions, but not more than in two points.

Example: If a family has a mortgage balance at the time of restructuring is 2 million rubles and, after checking the documents of AHML, the creditor bank decided to write off the debt in the amount of 20% of the balance of the principal debt, then with a mortgage of 12% per annum with a remaining term of 10 years payment to be reduced from the planned 28694 rubles. per month up to 22955. Benefit 5739 rubles.

There is an opinion that very often banks refuse to restructure mortgages, but in fact this procedure is very beneficial for them. losses incurred by the bank (lost interest income) due to early repayment are compensated by the state.

Changes in the assistance program for mortgage borrowers dated February 10, 2017 suggest that the maximum reimbursement of 30% of the balance (up to 1.5 million rubles) is compensated by the state only if the family has two children or you are disabled (child disabled), and combat veterans may also apply. With one child you can only claim 20%. The amendments dated August 10, 2017 make it possible to double the amount of the maximum payment by decision of a special interdepartmental commission. Also, a mortgage loan must be issued no earlier than 12 months before the date of filing an application for restructuring.

After analyzing the negative reviews about the payment of a mortgage with the help of the state, our experts came to the conclusion that most often the reason for refusal is false information provided by the borrower and lack of knowledge of the basic requirements and conditions for state support. Let's talk about them now.

Important point! The acceptance of documents under the Program has been suspended since December 2, 2018 and the program is no longer working.

Who can receive support from the state

Government Decree No. 373, as amended on November 24, 2016, provides for the following list of persons to whom the state can help pay mortgage payments:

  • Citizens of the Russian Federation with 1 or more minor children;
  • Guardians (custodians) of 1 or more minor children;
  • Participants in hostilities;
  • Disabled people or families with disabled children;
  • Citizens with dependent children under 24 who study full-time at an educational institution.

Mortgage requirements

To receive assistance from the state, a mortgaged apartment must meet these characteristics:

  • It should not exceed the total area for a one-bed apartment - 45 sq.m., for an apartment with two rooms - 65 sq.m. and for three rubles and more - 85 sq.m.
  • The cost of 1 sq.m. total area of ​​housing exceeds no more than 60% of the average cost of a typical apartment in your region on the date of conclusion of the loan agreement (according to the Federal State Statistics Service).
  • The dwelling must be the only one for the mortgage borrower. At the same time, it is allowed to have a total share of ownership of all family members of no more than 50% in one other residential building. The countdown on the availability of property is from 04/30/2015. Those. it will not be possible to quickly rewrite / donate “extra” real estate in order to become a member.

Important point! The requirement for the total area of ​​mortgage housing and the cost per square meter does not apply to families with 3 or more minor children. If you have more than 50% property in other housing, then you will be denied under the program, but you can transfer it to relatives and then everything will be ok. Requirements for mortgage borrowers

  • Russian citizenship
  • Your income is below two living wages at your place of residence for each person in the family, after subtracting your monthly mortgage payment from them. Three full last months are analyzed. In this case, the mortgage payment must increase by at least 30% of the initial payment.

Those. this program is only suitable for foreign currency mortgages and those borrowers who have a floating rate. For ordinary mortgage borrowers, a situation is impossible when the current payment is 30% higher than the original one. But when the interdepartmental commission starts working, it will be possible to submit an application for consideration there. up to 2 deviations from the conditions are allowed. If you have a co-borrower in the mortgage and he has a share in the property in this apartment, then he is obliged to provide a full package of documents both for himself and for his family members.

Now answer these questions. If you received the answer “NO” for one of them, then you will not be able to apply for participation in the mortgage borrower support program in 2019.

How to get government support

Now you already know that you can count on government support in paying off your mortgage. Now it remains to find out how to get it.

First of all, you need to contact the bank where you received the mortgage. Almost all major banks participate in this program of assistance to mortgage borrowers. The full list can be downloaded.

As a rule, this issue is dealt with by the department for dealing with overdue debts. It is enough just to call the contact center of your bank and find out where it is located.

The bank will give you a list of documents for state support for a mortgage. An example list is provided below:

  1. An application form with the obligatory indication of the reason for providing you with assistance from the state (reduction in income, reduction, decree, etc.).
  2. Passports, birth certificates of minors of all family members.
  3. Marriage certificate (if the marriage is registered).
  4. Certificate of divorce, change of full name, parents and children, agreement of parents on the residence of the child with one of the parents (if required).
  5. The decision of the guardianship authorities or the court decision on the establishment of guardianship (for guardians and trustees).
  6. War Veteran's Certificate (for veterans).
  7. Documents on disability from the borrower or co-borrower or from their children.
  8. Birth certificate for dependents under the age of 24.
  9. Certificate of family composition to confirm the residence of a dependent under 24 years of age with the borrower/co-borrower.
  10. A certificate from an educational institution stating that a child under 24 years old who is dependent on the borrower/co-borrower is studying full-time.
  11. Notice from the Pension Fund that a dependent person under 24 years of age does not have independent labor income.
  12. A certified copy of the work book of the borrower/co-borrower.
  13. Official certificate from work (for military or law enforcement officers).
  14. IP registration certificate (for individual entrepreneurs).
  15. Order of the Ministry of Justice of Russia on appointment as a notary (for notaries).
  16. Employment book and/or expired employment contract for the unemployed.
  17. Document on registration with the employment service (for unemployed).
  18. Notification of the pension fund on the state of the personal account of the insured person (for all).
  19. Certificate from the FSS of the Russian Federation on income from temporary disability, benefits and other payments.
  20. Certificate of income in the form of 2 personal income tax or in the form of a bank from all family members.
  21. Bank certificate on the total amount of family income (provided by the bank).
  22. Tax returns, patents, etc.
  23. Information about the amount of pension for pensioners.
  24. Loan agreement

The list is quite impressive and will make you run a little, but it's worth it. The only moment that is rather complicated is extracts from the USRN. They cost money. One statement on the rights to property throughout Russia is 1,500 rubles per person and no one will return them to you if you refuse. There were a lot of complaints about this last time. From 08/11/2017, the requirement for an extract from the USRN has been cancelled. The bank has no right to demand it. AHML independently requests it.

After full list documents submitted to the bank, the responsible officer must send them to AHML for verification. On average, it lasts 30 days, but the feedback from the participants indicates that it can reach up to six months. the bank and AHML request additional documents at their discretion.

When AHML makes a positive decision, the bank will notify you of the date of the meeting. Next, you will need to sign a new payment schedule, a new PSK document, conclude a restructuring agreement (additional agreement to the mortgage agreement), an agreement on changing the terms of the mortgage. Next, you will need to wait from 2 to 4 weeks, when the mortgage will be requested from the bank's archive. After that, it is necessary, along with a full package of loan documents and an agreement on changes in the terms of the mortgage (be sure to make copies), to visit justice for state registration of changes.

The process is similar in Gazprombank. VTB 24 closes the mortgage and issues a new loan for a smaller amount, which means that you again have to pay insurance and assessment costs.

There is no mortgage restructuring fee. Carrying out this procedure does not exempt you from paying the monthly payment and insurance premiums stipulated by the contract.

Period of the State Program

The issuance of loans under the State Program is possible no later than 12/31/22 (inclusive). If a second or third child is born between 07/01/2022 and 12/31/2022, a loan can be issued until 03/01/2023 (inclusive).

Citizens of the Russian Federation who have a second or third child born between 01/01/2018 and 12/31/2022 (inclusive), who has Russian citizenship.

For the purchase of residential premises (including with a land plot) in the primary market of a legal entity(with the exception of the investment fund, including its management company) under the Sale and Purchase Agreement (after the completion of the construction of the residential premises and registration of ownership of the legal entity, formerly the Developer/Investor).

According to the program "Acquisition of housing under construction":

For investing in the construction of residential premises in accordance with the Federal Law of December 30, 2004 No. 214-FZ “On Participation in Shared Construction of Apartment Buildings and Other Real Estate and on Amendments to Certain Legislative Acts Russian Federation»:

  • under an agreement for participation in shared construction concluded with developer (legal entity,
  • under an agreement for the assignment of the right to claim under an agreement for participation in shared construction concluded with investor (legal entity, except for an investment fund, including its management company).

Insurance

  • Compulsory insurance of property pledged in accordance with the requirements of PJSC Sberbank.
  • Compulsory life and health insurance of the Borrower/Title Co-borrower, subject to the following:

insurance is carried out for a period of at least 12 months with subsequent annual prolongation until the expiration of the loan agreement with a one-time payment of the insurance premium under the insurance policy/insurance agreement.

Life and health insurance of the borrower is a prerequisite for issuing a loan. Without this condition, the loan cannot be granted.

Extension/renewal of the preferential rate period:

If the Borrower/Title Co-borrower who received a loan at a preferential rate, due to the birth of a second child, has a third child (not later than December 31, 2022), then the term of the preferential rate may be extended / the preferential rate may be re-established, subject to the provision to the Bank of the child's birth certificate, and, if necessary, another document confirming the child's citizenship of the Russian Federation.

The period for which the preferential rate is extended/re-established:

  • for 5 years from the date following the expiration date of 3 years from the date of granting the loan (when a third child is born and supporting documents are submitted to the bank within 3 years from the date of granting the loan);
  • from the nearest Payment date following the day when the Borrower/Co-Borrowers provide supporting documents to the bank, for a period of, not exceeding 5 years from the date following the expiration date of 3 years from the date of granting the loan (when a third child is born within 3 years from the date of granting the loan and in case of providing supporting documents after 3 years from the date of granting the loan);
  • from the nearest Payment date following the day when the Borrower/Co-Borrowers provide supporting documents to the bank , for a period not exceeding 5 years from the date of birth of the third child(at the birth of a third child after 3 years from the date of the loan).

* if the borrower refuses to renew / terminate the life insurance contract, the annual interest rate on the loan will be increased to the maximum interest rate allowed under the Lending Program, namely: the key rate of the Central Bank of the Russian Federation on the date of the loan + 2 p.p.

** for the period until the first change in the key rate of the Central Bank of the Russian Federation. Additional requirements for the Borrower/Title Co-borrower

  • the Borrower/Title Co-borrower, starting from January 1, 2018 and no later than December 31, 2022, had a second and (or) third child with the citizenship of the Russian Federation.
  • the spouse(s) of the Borrower/Title Co-borrower (if the Borrower/Title Co-borrower is married) has citizenship of the Russian Federation.

Requirements for a co-borrower

  • The number of Co-Borrowers includes the Title Co-borrower, her (his) spouse (regardless of his (her) solvency, age and number of children born to her (him), as well as persons whose income is taken into account when calculating the maximum loan amount ( for whom the requirement to have children does not apply).

The government resumes support for mortgage borrowers who are in a difficult financial situation. Formally, assistance is provided for ruble and foreign currency loans, but mainly foreign currency borrowers will be able to use it.

The government published on the official website the terms of the renewed program of assistance to mortgage borrowers in difficult financial circumstances. As follows from the government decree, the updated program, which allows citizens to receive assistance from the state, will be tougher than the previous one. The key change is that although the updated program is formally valid for both ruble and foreign currency loans, in fact only foreign currency mortgage borrowers and people who have a loan in rubles, but with a variable rate, fall under it.

The total amount of the updated program is 2 billion rubles, the document says. Its extension will allow restructuring at least 1.3 thousand mortgage loans, according to the government website. As part of the updated program, banks restructure problematic foreign currency mortgages at a ruble rate for a client not exceeding 11.5% or ruble problematic mortgages at a rate not higher than the rate in effect on the date of loan restructuring.

The program itself comes into force seven days after the publication of official legal information on the website, that is, on August 22, explained Alexey Nidens, managing director of the Agency for Housing Mortgage Lending (AHML, program operator). “But borrowers can seek advice and apply to banks for participation in the program now - the procedure for working under the program is already well known to most credit institutions,” Niedens says. From August 22, banks participating in the state support program will be able to send their borrowers' applications for consideration to AHML, explained Tatyana Ushkova, Deputy Chairman of the Board of Absolut Bank. The deadline for the end of the program is not set in the document - it will end as the funds provided by AHML are exhausted.

As clarified in AHML, the program will involve 97 banks that cooperated with AHML and earlier under the previous version of the program. RBC polled large mortgage banks, but in the evening only Sberbank, Absolut Bank and Sovcombank were able to quickly give a positive answer about participation in the updated program. The rest of the surveyed mortgage market participants did not have time to respond to RBC's request.

The state program to support mortgage borrowers was launched in April 2015 and operated until May 2017. The government allocated 4.5 billion rubles for the first version of the program. In fact, the program ended ahead of schedule - banks in March 2017 chose the provided limit.

Initially, the program provided for the restructuring of ruble and foreign currency mortgage loans at a rate not exceeding 12% per annum and compensation for part of the monthly payment (but not more than 1.5 million rubles in total). Since December 2016, for a family with one or two children, the maximum amount of assistance was 20%, but not more than 600 thousand rubles. For all other categories of citizens listed in the resolution (including citizens with disabilities, veterans) - 30% and 1.5 million rubles.

According to the banks participating in the program, during the period of its implementation, over 50,000 applications from citizens for restructuring mortgage housing loans were received. Of these, assistance was approved for 19,000 borrowers. According to the Kommersant newspaper, 16,000 applications met the requirements at the end of the program, but were not restructured due to the exhaustion of the AHML fund. Now these borrowers will have to apply for help again, according to a new government decree.

What's new in the terms of the program?

The main difference between the new program and the old one, which cuts off problematic ruble borrowers, is formalized as a new condition for participation in the program for borrowers, which did not exist before. Namely: it will be possible to take part in the program only in case of a sharp increase in the size of the monthly payment - by at least 30%. “As a result, as the director of the Mortgage Lending Directorate of TKB Bank Vadim Pakhalenko clarifies, in fact, only foreign currency mortgage borrowers and people who have a loan in rubles, but with a variable rate, fall under the program.”

“It must be understood that the first wave of the program to support mortgage lenders in difficult situations was more focused on holders of ruble loans - only a small share of the previously allocated 4.5 billion rubles. fell on foreign currency mortgagers, - says Vyacheslav Putilovsky, junior director for banking ratings at Expert RA. - But the problem of foreign currency mortgages remains, and, apparently, the government decided to make such a cut-off for ruble mortgages in order to solve at least partially the issues of the former. I think that this is quite fair, given that only 2 billion rubles have been allocated for the second wave.”

Previously, the approach would have been different. According to Elena Kovyrzina, director of the retail business lending department at Absolut Bank, during the work of the last program in their bank, the main part of the restructuring fell on clients with ruble mortgages - these turned out to be 65% of the total number who received support. It will also not be possible to reconstruct a recently issued mortgage. The new regulation clarifies that it is possible to apply for participation in the program only if the “life” of the loan has already exceeded one year.

Mortgage housing, as previously provided, must be the only residence of the borrower's family from April 30, 2015 until the date of the borrower's application for participation. But AHML will now independently check the data from the Unified State Register of Real Estate, Niedens adds. As one of the participants in the discussion of the extension of the program explains, this was done in order to relieve citizens of the financial burden of preparing documents - an extract for one of the family members costs about 1.5 thousand rubles.

Another innovation is the creation of an interdepartmental commission that will have the right to decide on providing support to citizens who are in dire need of assistance, but do not formally meet the necessary two conditions of the program, Niedens explained. The terms of the AHML mortgage program at Sberbank impose certain restrictions on the area of ​​collateral. The maximum size of a one-room apartment cannot be more than 45 sq. meters. According to the terms of the AHML mortgage program at Sberbank, the applicant must present an insurance contract and a receipt confirming the payment of the insurance premium. The list of securities can be changed at the request of Sberbank managers. If the lender approves the restructuring, the balance of the debt will be reduced by 30% (the maximum amount of compensation is 1.5 million rubles).

Accrued fines and penalties will be written off (except for penalties that the borrower had to pay on the basis of a court decision). If the loan was issued in a foreign currency, then its amount must be recalculated at a special rate (it must be lower than the official currency quotes). The marginal cost of a foreign currency loan is set at 11.5% per annum.

Experts of the Accounts Chamber believe that the program of assistance to foreign currency borrowers has serious shortcomings. Officials believe that the conditions for providing financial assistance are not transparent enough. The consequence of this is a large percentage of refusals to grant budget benefits. The program is designed mainly for foreign currency borrowers. Clients who have taken a loan in rubles have practically no chance of receiving subsidies.

Banks are extremely reluctant to renegotiate contracts. They in every possible way delay the process of considering applications for the AHML mortgage program at Sberbank and refuse to provide preferential terms to most applicants. Bankers do not want to worsen the quality of the loan portfolio, as this will require the creation of additional financial reserves.

Employees of the Accounts Chamber believe that the number of restructured mortgage loans is underestimated, which indicates the misuse of budget funds (according to official data, about 1,300 contracts were revised). This problem was described in a letter sent to AHML. The answer to the request of the Accounts Chamber has not yet followed.

The attitude towards foreign currency borrowers in society is ambiguous. Someone sympathizes with bank customers, and someone condemns them. Most mortgage borrowers took out a loan before the sharp collapse of the ruble exchange rate. People took foreign currency mortgages, as the rates on it were lower than on ruble loans. This fact is the reason for heated public discussions.

Many people believe that Sberbank customers should solve their problems themselves. They indicate that material assistance is provided at the expense of public funds (i.e., at the expense of taxpayers). Someone says that helping mortgage borrowers could lead to a renegotiation of the terms of conventional loan agreements.
